Why is the year limit long after a felony to get job w/ SOS

My husband got messing around with drugs years ago, he went to prison and was charged with drug possesion, he was released from parole in 2004. But he was released from prison and has been a law abiding citizen since 2001. So until 2009 he can not get employment with SOS. This just does not seem fair at all.
